Legal Structure

Teign Valley History Centre is a body set up by and owned by the Trustees of the Teign Valley Museum and Archive Trust to work to establish a centre for local history in the area; to develop an archive of documents which can be accessed free of charge on the internet or inspected physically when premises are available; to promote events to explore our heritage and to educate people of all ages about the history of the Teign Valley.

Teign Valley Books is a body set up and owned by the Trustees to publish books and other material relating to the history of the Teign Valley.

We work closely with, but are separate from, the Teign Valley History Group which has its own committee, funds and a separate website. A link to their site is on the resources page of this website.

7.1 This Website is controlled and operated by us in England. The formation, existence, construction, performance, validity in all aspects whatsoever of these terms and conditions or of any term of these terms and conditions or any dispute in relation to the materials contained in this Website shall be governed by English law. The English and Welsh courts shall have exclusive jurisdiction to settle any disputes which may arise out of or in connection with these terms and conditions or use of the Website.

This Privacy Statement sets out how Teign Valley History Centre complies with relevant data protection requirements. This applies to the entire website and any other computer systems used by us, as well as any manually held records. We take your privacy very seriously.

Teign Valley History Centre is committed to respecting your privacy. Once you choose to provide information to us it will only be used in accordance with this privacy statement. We do reserve the right to change this privacy statement at any time. The date it was last updated is clearly shown at the top of this section.

WHAT WE COLLECT

We collect the following information about supporters of the Teign Valley History Centre:
• Name and address
• Age and date of birth, or an indication that you are an adult supporter
• Contact information including email address, telephone numbers and postal address
• Demographic information such as location, preferences and interests
• Other information relevant to customer surveys and/or offers
• Photographic images from time to time
• Payment information is held by Just Giving during the processing of a donation.

We collect the following information about all users of the Teign Valley History Centre Website:
• We record information about key activities performed on our website, e.g. page views, referring sites and technical information about operating systems and browsers used. This information, which is not personally identifiable, is used for site usage data analysis in order to deliver a better service to the users of this website.

WHAT WE DO WITH THE INFORMATION WE COLLECT

We require the information we collect to understand your needs and provide you with a better service, and in particular, for the following reasons:
• To run the History Centre and communicate with supporters or prospective supporters about activities. This information is not held on the website but is held in separate computer software and in paper records.
• Internal record keeping.
• To improve our products and services, and
• To maintain the website and publicise the History Centre.

We do not retain any information on prospective supporters and do not market to prospective supporters.

We will not sell, distribute or release any information to third parties unless we are required to by law.

Terms of Use for the Teign Valley History Centre Community Space: updated 23/05/2022

1. In these terms of use the word Website refers to the website operated by and owned by the Teign Valley Museum and Archive Trust (“the Trust”). The Trust also uses the name the Teign Valley History Centre.

2. The Trust has created a Community Space on its website for the use of all who are interested in or studying the history of the Teign Valley.

Purpose of the Community Space

3. The purpose of the Community Space is to provide a space where Contributors can upload documents and images to enable them to be shared by others; and to offer a space in which Contributors can comment on documents and artefacts uploaded by others or respond to comments previously uploaded.

4. The Trust provides this space to enable Contributors to share with all those who visit the Website digital copies of documents or images of artefacts which will or may be of interest to those who study or are interested in the history of the Teign Valley and to enable other Contributors to upload comments for discussion concerning these digital documents. The Trust will also welcome articles or other written material concerning the history of the Teign Valley and comments contributing to debate about issues raised in the Community Space and about matters of interest to those using the Website for these purposes.

How to become a Contributor

5. Any person wishing to upload documents or comments to the Community Space must first register as a Contributor by completing the registration form to be found in the Community Space section of the Website. The Trust will have complete discretion as to whether to admit an applicant. Without prejudice to the unfettered nature of that discretion, applicants will be rejected if the Trust have reason to believe that they will or might misuse their membership of the Community by posting
- abusive or offensive material or comments
- material in breach of copyright laws
- material that is not relevant to or suitable for the intended audience
- defamatory material or comments
- material or comments that are unlawful or in the opinion of the Trust unsuitable for the Website

6. The Trust will notify the applicant whether they have been registered as a Contributor.

Editorial control of material.

7. Subject to the editorial control of the Trust, a Contributor will be able to use the Community Space to upload documents to the Website and to comment on documents or images uploaded by other Contributors or by the Trust and to respond to such comments made by others.

8. Any document or comment uploaded for the Community Space will be reviewed by the Trust who will have an unfettered discretion as to whether the item is posted for publication in the Community Space but in particular any item may be rejected for any of the reasons listed at paragraph 5 above or if it is inconsistent with the Ground Rules set out below. Items may also be rejected if they are not of sufficiently good resolution or if the image is of poor quality. Before rejecting any item we will first attempt to work with a Contributor to improve the resolution or quality to an acceptable standard for publication.

Ground Rules

10. Personal abuse and bullying by name-calling, insults or threats to other users and authors will be removed. We do not tolerate religious abuse, racism, sexism, homophobia, minority abuse or any hate-speech. Profanity (bad language) may automatically be filtered and removed from the comments section.

11. Potentially defamatory comments about individuals, companies or organisations are not permitted nor any material that infringes the privacy or data rights of others. Do not post text or images that breach copyright.

12. Any comments containing conspiracy theories and/or deliberately misleading information which could be injurious to third parties will result in a suspension or permanent restriction from commenting.

13. Comments will be removed if they are not deemed as on topic to the article they are posted under. Any content deliberately promoting a business/product will be removed. Repeatedly posted spam-like content may also be removed.

14. Impersonation of other users or public figures will result in the removal of comments. Offensive usernames will also be removed/cancelled.

15. Copyright in any image offered for publication will remain with the creator of that image but by uploading the image a Contributor warrants either that they own the copyright in the image and give permission for its publication on the Website or that the Contributor has the permission of the owner of the copyright to upload the image and that the owner gives permission for its publication on the Website.

16. Contributors are requested to give as full a description of any document or item offered for upload as possible to include the purpose of the document or object its age its provenance how it came into the possession of the contributor or owner and any information available about those who have owned or had possession of it previously.

17. The Trust shall have the right to seek additional information about any item offered for posting before deciding whether or not to approve its publication. The Trust may also edit any information or images uploaded, but will not misrepresent the Contributor and will where possible agree any changes with the Contributor before publication.

18. The Contributor has the right to demand removal of any uploaded material within 14 days of written request.

19. The Trust has the right to remove any uploaded material from the Community Space at any time at its absolute discretion.

Removal of Contributor Status

20. if any Contributor acts in a way which is inconsistent with the Terms of Use set out in this document the Trust shall have the power to remove the Contributor status of that person who will be barred either temporarily or permanently from contributing to the Community Space.
